2. Proposed amendments to Civ.R. 41, previously submitted to the General Assembly, are withdrawn.

3. Proposed amendments to App.R. 24 will be resubmitted to the General Assembly as modified.

DOUGLAS and RESNICK, JJ., dissent and would withdraw from the General Assembly the proposed amendments to App.R. 24, Civ.R. 26, and Civ.R. 41 consistent with their previous votes.
