THE COURT FINDS THAT:

{¶ 1} On June 26, 2002, plaintiff, Jason A. Alspaugh, filed a complaint against defendant, Court of Claims of Ohio;

{¶ 2} On November 5, 2002, this court issued an order (Jr. Vol. 724, Pgs. 84-85) dismissing Court of Claims of Ohio as defendant and requiring plaintiff to submit an amended complaint which names a proper defendant on or before November 25, 2002, or face dismissal of his case;

{¶ 3} A review of the docket reveals plaintiff has not submitted an amended complaint.

{¶ 4} IT IS ORDERED THAT:

{¶ 5} Plaintiff’s case is DISMISSED without prejudice;

{¶ 6} The court shall absorb the court costs of this case in excess of the filing fee.
