ENTRY OF DISMISSAL {¶ 1} On April 15, 2005, plaintiff, Sonny Alvarez, filed a complaint against defendant, Hamilton County Justice Center. On April 18, 2005, this court issued a pre-screening entry dismissing Hamilton County Justice Center as a party and requiring plaintiff to submit an amended complaint which names a state department, board, office, commission, agency, institution, or other state instrumentality as defendant.

{¶ 2} On April 27, 2005, plaintiff filed an amended complaint which names the Hamilton County Sheriff’s Department, et al. as defendants. On April 29, 2005, this court issued a second pre-screening entry dismissing Hamilton County Sheriff’s Department, et al. as defendants and again requiring plaintiff to name a state entity as defendant or face dismissal of his claim.

{¶ 3} On May 16, 2005, plaintiff filed an amended complaint which names Hamilton County and Hamilton County Sheriff’s Department as defendants. Both defendants named are not state entities. According plaintiff’s case is dismissed without prejudice. Court costs shall be absorbed.
