{¶ 1} On May 2, 2003, this court issued an entry dismissing Post Office as a party and requiring plaintiff to file an amended complaint naming a proper defendant on or before May 29, 2003, or face dismissal of his case. Plaintiff has failed to comply with the court order. Therefore, plaintiff’s action is DISMISSED, without prejudice, pursuant to Civ.R. 41(B)(1). The court shall absorb the costs of this case. The clerk shall serve upon all parties notice of this judgment and its date of entry upon the journal.
