Brandon Bails, Plaintiff v. Department of Transportation, Defendant.

No. 2005-07682-AD.Court of Claims of Ohio.
Filed January 26, 2006.

[EDITOR’S NOTE: This case is unpublished as indicated by the issuing court.]

Brandon Bails, 692 Whippoorwill Drive, Cincinnati, Ohio 45244, Plaintiff, Pro se.

ENTRY OF DISMISSAL {¶ 1} On June 22, 2005, plaintiff filed a complaint but failed to name a defendant or submit the filing fee or a poverty statement. On June 22, 2005, this court issued a return of complaint form/direction to complete form requiring plaintiff to name a defendant and provide an address for the defendant so that the complaint could be served. On June 22, and July 28, 2005, this court issued notices to pay the filing fee. The notices directed the plaintiff to either pay the filing fee or file a poverty statement. Plaintiff did not respond to any of the notices issued by the court.

{¶ 2} On October 26, 2005, this court issued an entry finding, from the pleadings, that plaintiff sought to sue the Department of Transportation for damages sustained by his vehicle. However, plaintiff was given 30 days to submit either the filing fee or a poverty statement or face dismissal of his case. A check of the docket reveals plaintiff has failed to comply with the court’s entry of October 26, 2005. Accordingly, plaintiff’s case is DISMISSED, without prejudice. The court shall absorb the court costs of this case.
