ORDER DISMISSING PLAINTIFF’S CASE {¶ 1} THE COURT FINDS THAT:

{¶ 2} 1) On August 30, 2002, plaintiff, Richard E. Baker, filed a complaint against defendant, Department of Transportation. Plaintiff submitted the filing fee with the complaint;

{¶ 3} 2) On November 21, 2002, this court received a motion from Beth A. Dinsmore, on behalf of the Department of Transportation, requesting an extension of time in which to file the investigation report;

{¶ 4} 3) Defendant also filed a motion to add the Office of Risk Management as defendant;

{¶ 5} 4) On January 7, 2003, plaintiff submitted a letter requesting that his case be dismissed.

{¶ 6} IT IS ORDERED THAT:

{¶ 7} 1) Defendant’s motions of November 21, 2002, are MOOT;

{¶ 8} 2) Plaintiff’s letter is considered a motion to voluntary dismiss and is GRANTED;

{¶ 9} 3) Plaintiff’s case is DISMISSED without prejudice;

{¶ 10} 4) The court shall absorb the court costs of this case in excess of the filing fee.
