ENTRY OF DISMISSAL {¶ 1} On April 2, 2007, plaintiff filed a complaint naming Dayton Montgomery County Sheriffs Office as defendant. On April 3, 2007, this court issued an entry dismissing Montgomery County Sheriffs Office as defendant and requiring plaintiff to submit an amended complaint naming a state agency or instrumentality as defendant or face dismissal of his case.

{¶ 2} On April 18, 2007, plaintiff filed an amended complaint naming the “State of Ohio” as defendant, but a review of the pleadings reveals his law suit is against the Montgomery County Jail. The Montgomery County Jail is not a state entity. Accordingly, plaintiffs complaint is dismissed without prejudice. The court shall absorb the court costs of this case.
