ENTRY OF DISMISSAL

{¶ 1} On July 28, 2003, this court issued an entry dismissing Timothy Campbell, Judge as defendant and requiring plaintiff to submit an amended complaint naming a state entity as defendant.

{¶ 2} On August 6, 2003, plaintiff filed an amended complaint naming Green County Common Pleas as defendant. On August 8, 2003, this court issued an entry dismissing Green County Common Pleas as defendant and required plaintiff to submit an amended complaint naming a state department, board, office, commission, agency, institution, or other state instrumentality as defendant.

{¶ 3} On August 13, 2003, plaintiff filed a second amended complaint naming the “State of Ohio” as defendant but providing the address for the Green County Common Pleas Court. A review of plaintiff’s complaint reveals his disputed concerns a criminal sentence rendered by a Green County Common Pleas Court Judge and not any action of the State of Ohio or its agencies.

{¶ 4} Accordingly, plaintiff’s case is DISMISSED without prejudice. The court shall absorb the court costs of this case. The clerk shall serve upon all parties notice of this entry of dismissal and its date of entry upon the journal.
