ENTRY OF DISMISSAL {¶ 1} On October 1, 2004, this court issued a pre-screening entry dismissing County Commissioners/Sheriff Detective Steve Walker as parties in this action and ordered plaintiff to file an amended complaint naming a state department, board, office, commission, agency, institution, or other state instrumentality as defendant or face dismissal of his case. Plaintiff was also ordered to either pay the $25 filing fee or to file a poverty statement with supporting documentation. Plaintiff has failed to comply with the court orders. Therefore, plaintiff’s action is DISMISSED, without prejudice, pursuant to Civ.R. 41. The court shall absorb the costs of this case. The clerk shall serve upon all parties notice of this entry of dismissal and its date of entry upon the journal.
