ORDER DISMISSING PLAINTIFF’S CASE {¶ 1} THE COURT FINDS THAT:

{¶ 2} 1) On December 13, 2002, plaintiff, Johnny Cunningham, filed a complaint against defendant, Belmont Correctional Institution. Plaintiff alleges defendant’s agents negligently lost his tennis shoes. This claim was assigned case no. 2002-10828-AD;

{¶ 3} 2) On January 29, 2003, plaintiff, Johnny Cunningham, filed a complaint against defendant, Belmont Correctional Institution. Plaintiff alleges the same facts as contained in case no. 2002-10828-AD.

{¶ 4} IT IS ORDERED THAT:

{¶ 5} 1) Case no. 2003-01946-AD is duplicative of case no. 2002-10828-AD;

{¶ 6} 2) Case no. 2003-01946-AD is DISMISSED;

{¶ 7} 3) The court shall absorb the court costs of this case.
