ENTRY OF DISMISSAL {¶ 1} On April 2, 2004, plaintiff filed a complaint against defendant, John Williams, Assistant Prosecutor. On April 6, 2004, this court issued a pre-screening entry dismissing John Williams as a defendant and requiring plaintiff to name a state department, board, office, commission, agency, institution, or other state instrumentality as defendant. On April 6, 2004, this court also issued a notice to pay the filing fee or file an affidavit of poverty.

{¶ 2} On April 26, 2004, plaintiff submitted a letter requesting that his claim be dismissed. Plaintiff’s letter is considered a motion for voluntary dismissal and is GRANTED. Plaintiff’s case is dismissed without prejudice and the court shall absorb the court costs of this case.
