ENTRY OF DISMISSAL {¶ 1} On July 7, 2004, plaintiff was ordered to submit either the $25 filing fee or a poverty affidavit on or before August 4, 2004. On July 23, 2004, a letter was submitted on behalf of the plaintiff attempting to increase the prayer amount by $380.00.

{¶ 2} Plaintiff has failed to comply with this court’s notice. Therefore, plaintiff’s action is DISMISSED without prejudice pursuant to Civ.R. 41(B)(1). The July 23, 2004, filing is considered a motion to amend the complaint and is MOOT. The court shall absorb the costs of this case. The clerk shall serve upon all parties notice of this entry of dismissal and its date of entry upon the journal.
