IT IS ORDERED by the court, sua sponte, that this court’s August 17, 2004, entry be, and hereby is, vacated, and this appeal is reinstated.
IT IS FURTHER ORDERED by the court that appellees’ merit brief is due thirty days from the date of this entry and the parties shall otherwise proceed in accordance with S.Ct.Prac.R. VI.
