On review of order certifying a conflict. The court determines that a conflict exists. The parties are to brief the issue stated in the court of appeals’ Entry Granting Motion to Certify Conflict filed January 11, 2006:
“Whether a dismissal other than on the merits which prevents re-filing in the trial court is a final, appealable order.”
