This cause is pending before the court as an appeal from the Court of Appeals for Union County. Upon consideration of appellee’s motion to reschedule oral argument, appoint counsel, and set a deadline to file a merit brief,
It is ordered by the court that the motion is granted in part. The oral argument scheduled for June 3, 2009, is hereby cancelled and shall be rescheduled at a later date.
It is further ordered that the Ohio Public Defender, who has entered a notice of appearance as counsel for appellee, shall file a merit brief within 30 days of the date of this entry. Appellant may then file a reply brief as permitted by S.Ct.Prac. R. VI(4).
