ENTRY OF DISMISSAL {¶ 1} On September 8, 2004, this court issued a pre-screening entry dismissing Montgomery County Sheriff as a party and requiring plaintiff to submit an amended complaint which names a state department, board, commission, agency, institution or other state instrumentality as defendant.
{¶ 2} On September 29, 2004, plaintiff filed an amended complaint naming Montgomery County Jail as defendant. Montgomery County Jail is not a state entity. Accordingly, plaintiff’s case is DISMISSED without prejudice for failure to name a proper defendant. The court shall absorb the court costs of this case.
